Die BuReg hat sich mehrfach für eine „#SafeHarbour“-Regelung ausgesprochen. Damit wäre die Haftung eines Unternehmens für Menschenrechtsverletzungen entlang der Lieferkette ausgeschlossen, wenn es z.B. Mitglied in einer Branchen-/Multi-Stakeholder-Initiative ist.

Rechte-Inhaber*innen hätten dann keine Möglichkeit, Menschenrechtsverletzungen in einem Zivilprozess geltend zu machen.

Ein solcher Haftungsausschluss ist mit den Grundsätzen des Europarechts nicht vereinbar!

Das Papier liest sich sehr ähnlich wie die Argumente, die die Kommission vor Gericht vorbrachte, bevor die von ihr vorgeschlagene Richtlinie zur #Vorratsdatenspeicherung und die von ihr ausgehandelten #SafeHarbour/#PrivacyShield-Deals spektakulär vor dem EuGH scheiterten.

#BigSister Ylva Johansson touts a Commission paper in which the authors of the #ChatControl #CSAR #MassSurveillance proposal once again deny that it violates fundamental rights. This assessment is as "independent" as listening to Putin on the war against Ukraine.

The paper reads much like the arguments the Commission presented in Court before the #DataDetention directive it had proposed and the #SafeHarbour/#PrivacyShield schemes it had negotiated failed spectacularly.

The Commission's arguments were already dismissed by the independent legal assessments presented by EPRS and Council Legal Service that clearly find bulk searches of our private communications content are indiscriminate and violate the essence of fundamental rights.

Thus fact remains that #ChatControl will fail to protect children already for the reason that the courts would strike it down.

Let's give children the protection they deserve: effective, rights-respecting and compliant!

@Wolf480pl but you see how easily we get into the weeds on this, right? Imagine trying to explain these technical differences to politicians who have to make laws regulating all this?!? ;P It's not going to work. We need to be able to articulate principles that apply to hosts of all kinds, from UGC hosting to "shared server" hosting, to "cloud" hosting, to "VPS" hosting, to leasing access to the net. All of them need to have #SafeHarbour from the actions of their users.
