Sound familiar? That’s because in July 2020, Canada filed a Motion to Strike against the Misdzi Yikh Charter challenge. Several years and an appeal hearing (that ended with the Federal Court of Appeal deciding that the section 7 of the Charter challenge was justiciable) later, Canada has filed for another Motion to Strike.
