Mr "good order and discipline” will lead the United States Military, anyway?

I've often wondered why #adultery is not a #crime. Most people would say adultery is unethical, perhaps even gravely so; the three Abrahamic religions judge adultery to be a grave sin [0]; considering the harm principle of liberalism, of course adultery harms an unconsenting third party. So why not?

I see that it was a crime in NY State until last week: apnews.com/article/new-york-ad

  A matrimonial complication was dealt with by Mr. Justice #Reed in the Supreme Court, when he gave decisions in an undefended #divorce case which was followed by an application for a decree of nullity of marriage. The same man was respondent in both petitions.
  Elizabeth #Webber sought dissolution of her marriage with Mark Webber, labourer, Auckland, on the ground of #adultery, the man having gone through the form of marriage with Mary Finlay #Sharkie, widow. The last-mentioned sought annulment of the marriage with Webber.

  A private inquiry agent stated when he served the papers he told Webber his wife was instituting divorce proceedings. He asked, “Which one?” Witness replied, “Both of them.” Mrs. Sharkie was present. Turning to her he said: “This is your little game. You have set a trap for me.”
  His Honour granted a decree nisi to Mis. Webber and granted Mrs. Sharkie a decree absolute for nullity of the marriage, with costs on the lower scale against respondent.
  The women left the Court together.
